Item 1.04. Mine Safety – Reporting of Shutdowns and Patterns of Violations.
On September 17, 2015, the Mine Safety and Health Administration ("MSHA") issued an imminent danger order under Section 107(a) ("Order") of the Federal Mine Safety and Health Act of 1977 to Bentonite Performance Minerals, LLC, a Halliburton owned company. The Order alleges that the driver of a semi-trailer truck was working atop a flatbed trailer approximately eight feet off the ground. The truck driver was employed by a third party, an independent contractor, not Bentonite Performance Materials, LLC. The contractor employee dismounted the trailer. No injuries occurred as a result of the cited conditions.
