TheGrantLawFirm, PLLC Investigates United Parcel Service, Inc. for Possible Breaches of Fiduciary Duty

TheGrantLawFirm, PLLC is investigating a potential action on behalf of United Parcel Service, Inc. (“UPS” or the “Company”) for possible breaches of fiduciary duty by the Company’s officers and directors, relating to UPS’s purported failure to comply with federal and state laws.

On February 18, 2015, New York State Attorney General Eric T. Schneiderman and New York City Corporation Counsel Zachary W. Carter announced the filing of a multimillion-dollar lawsuit alleging that UPS “unlawfully shipped over 136 million contraband cigarettes – or nearly 700,000 untaxed cartons— across New York State in violation of federal and state laws.”

The Complaint filed in federal court in Manhattan, alleges that from at least 2010 through the present, UPS “knowingly ship[ed] and deliver[ed] thousands of cartons of unstamped cigarettes from manufacturers to unlicensed wholesalers and/or retailers ... and then again, delivered such cigarettes ... to residences in New York City and State, and indeed nationwide.” According to the Complaint, these deliveries “support numerous illegal cigarette trafficking enterprises,” and rob “the State and City of millions of dollars in tax revenue.”

The Complaint further alleges that the deliveries also violated an October 2005 Assurance of Discontinuance agreement that UPS entered into with the New York State Attorney General, following an investigation into similar allegations.

The Complaint could result in significant damages against the Company and cases by other attorneys generals around the country. If you are a current holder of UPS shares, would like to discuss this investigation and/or are interested in helping the Company recover its damages, please contact, Jorge Amador at 212-292-4449/jamador@grantfirm.com or Lynda J.
