Dr. Pepper Snapple Group(R) under the its manufacturing company, The American Bottling Company, Inc., will produce and bottled flavored carbonated and non-carbonated beverage products under the Giddy Up(TM) trade names and trade mark.
The American Bottling Company shall produce, package, store and ship GIDDY UP ENERGY Products(TM) Products in accordance with Good Manufacturing Practice requirements set forth in regulations promulgated under the Federal Food, Drug & Cosmetic Act (the "FFDC Act") (collectively, "GMPs"), and in compliance with the Product Specifications, quality control standards and coding systems supplied by Customer. All GIDDY UP Products(TM), Ingredients and Packaging Materials supplied by Company shall conform to Product Specifications. Company warrants that Company's Bottling Facilities currently have and at all times during the Term of this Agreement shall have a documented Hazard Analysis and Critical Control Points ("HACCP") program as required by applicable U.S. regulations.

Regarding Zoning:
Our pre-hearing with the Ontario Municipal Board is scheduled for the first week of January, 2016. CEN Biotech Inc. v. Town of Lakeshore, Ontario Municipal Board; Appeal of the Town's attempt to retroactively enforce a new bylaw on the property. The use of the property was deemed in conformance with the zoning bylaw at the time, as evidenced by the minutes of the Lakeshore Town Council meeting held November 7, 2013, wherein the economic development officer stated that CEN's property had "the correct zoning" for growing and producing medicinal marijuana. The property's facility was also approved and deemed by Health Canada to be compliant with all regulations for such a grow facility during the final inspection conducted prior to the determination of CEN's application to grow medicinal marijuana.
Regarding Judicial Review:
Cross-examinations (depositions) are scheduled for the second week of December, 2015. CEN Biotech Inc. v. The Minister of Health (s.18.1 Application for Judicial Review) Federal Court of Canada.
Regarding NAFTA Claim:
The company filed notice of intent to submit a claim to the Arbitrator under Section B of Chapter 11 of the North American Free Trade Agreement. The Government of Canada responded with an Intent to "vigorously" defend the claim. It should be noted that CEN Biotech also intends to prosecute its NAFTA claim vigorously.
