On July 29, 2015, the U.S. Department of Commerce (“DOC”) calculated a preliminary subsidy rate of 2.04% for Resolute Forest with respect to imports of supercalendered paper from Canada. Then, on October 15, 2015, Resolute Forest announced that the DOC, after concluding a countervailing duty investigation, had determined a final subsidy rate of 17.87% for the Company. The DoC stated that the increased subsidy rate is based on the application of "adverse facts available," saying the company "did not fully cooperate with the investigation.”
