Xarelto Lawsuit Update: New Wrongful Death Lawsuit Consolidated into MDL

BloodThinnerHelp.com reports today on a notable lawsuit that was recently filed in the Xarelto MDL.  This is a wrongful death lawsuit that was filed by the daughter of a deceased man who was taking Xarelto to treat a heart condition he suffered from.  The case was originally filed in Vermont federal court under the case number 2:14-CV-00159-CR and has recently been consolidated into the Xarelto multidistrict litigation.  The full complaint can be downloaded and read here.

Xarelto Prescribed to Treat Deceased’s Atrial Fibrillation:

According to the filed complaint, the deceased was prescribed Xarelto on July 17, 2012 to treat his atrial fibrillation and the blood clots and stroke that could result from it.  The deceased regularly took the drug until he was hospitalized for a parenchymal hemorrhage in late July 2012.  Because Xarelto was present in his system at the time of the bleeding event, his blood was not able to clot during the hemorrhage.  This lead to an uncontrollable internal bleed and further serious complications.  After six days of hospitalization, he passed away due to the complications on August 1, 2012. 

Wrongful Death Lawsuit Allegations:

The lawsuit alleges that Xarelto was the main cause of the man’s internal bleeding injuries and resulting death.  Further, this lawsuit alleges that the manufacturers of Xarelto, pharmaceutical conglomerates Bayer AG and Janssen Pharmaceuticals, failed to adequately warn doctors and patients about the true dangers of the drug, failed to provide doctors with information on how to stabilize patients in the event of an internal bleeding incident, and that the manufacturers were reckless and negligent by releasing the drug onto the market without a corresponding antidote.  The complaint filed also notes that if the plaintiff and her father were made aware of the accurate risks regarding Xarelto usage, he would have chosen one of the safer alternatives available on the market, such as Warfarin, a traditional blood thinner that comes with a common and simple reversal antidote.

Being a wrongful death lawsuit, it is brought forward by the administrator of the deceased’s estate, in this case his daughter.  The lawsuit is seeking damages for medical expenses, probate, attorney fees, pain and suffering, funeral and burial expenses, and other expenses related to the deceased’s estate.

This lawsuit is currently consolidated in the Xarelto MDL in the United States District Court for the Eastern District of Louisiana in New Orleans along with more than 1,200 lawsuits from across the country all making similar allegations against the manufacturers of Xarelto.
