David Russ, a leading estate planning and probate attorney based in Durham, is advising executors and administrators to focus less on generalized “probate sale strategies” and more on understanding how North Carolina’s procedures actually apply to their situation.
“In North Carolina, there isn’t just one way to sell real property during an estate,” Russ said. “The authority to sell—and the level of court involvement—depends on how the estate is administered and how the property is titled.”

Russ notes that one of the most common misconceptions is that probate property must be sold at a discount or through a rigid court process. “That’s not how it typically works here,” he said. “Most estate sales in North Carolina can proceed through the open market, provided the proper authority is in place and the fiduciary duties are being met.”
Those fiduciary duties remain central. A personal representative must act in the best interest of the estate, which includes obtaining fair market value and ensuring that the sale is properly documented and accounted for. Other key responsibilities can include maintaining the home’s condition, handling repairs before listing, and ensuring transparency with potential buyers regarding court procedures. “When buyers understand the probate timeline, it builds confidence and reduces the risk of withdrawn offers,” added Russ.
“From a practical standpoint, the issues we see are less about ‘probate restrictions’ and more about coordination,” Russ said. “You have heirs with competing interests, questions about who has authority to sign, and sometimes properties that haven’t been maintained. Those are the factors that impact value—not the probate label itself.”
Russ advises executors to address authority early, confirm title status, and work with professionals who understand estate administration in North Carolina—not just general real estate transactions.
“Getting it right on the front end avoids delays, disputes, and unnecessary expense,” he added. “In most cases, the goal is not complicated: clear authority, a clean transaction, and a defensible sale price.”
“Selling real estate during probate can feel overwhelming, but with the right legal and financial team, it’s entirely possible to achieve a strong sale price and honor the decedent’s legacy,” Russ concluded.
